asked the Secretary of State for Employment when, and in what manner, he expects the agreement by the Council of Ministers in June on the EEC directive on packaging and labelling, VI amendment, to be implemented in the United Kingdom.

Mr. Mayhew

[pursuant to his reply, 30 November 1979, c. 808]: I am advised by the chairman of the Health and Safety Commission that it is proposed that the provisions of the directive in relation to the notification of new substances should be implemented by regulations to be made by the Health and Safety Executive and the Department of the Environment under the Health and Safety at Work etc. Act and the European Communities Act. Member States are required to implement the notification provisions of the directive not later than 18 September 1981 and it is hoped that these regulations will be made by that date.

It is proposed that the classification, packaging and labelling provisions of Directive 79/831/EEC should be implemented by regulations made to amend the Packaging and Labelling of Dangerous Substances Regulations 1978 (SI 1978, No. 209) which implemented the original Directive67/548/EEC as last amended. Member States are required to implement limited amendments made to the existing packaging and labelling rules applicable to certain listed substances and to implement provisions for the packaging and labelling of dangerous substances subject to the notification procedure not later than 18 September 1981 and then to implement provisions for the packaging and labelling of all other dangerous substances in scope not later than 18 September 1983. It is hoped to meet these requirements.
