HC Deb 21 February 1977 vol 926 c506W
Mr. Spearing

asked the Attorney-General on how many occasions courts in the United Kingdom have given verdicts under Section 3 of the European Communities Act.

The Attorney-General

Section 3 of the European Communities Act 1972 does not confer jurisdiction on courts in the United Kingdom; it provides that where a question as to the meaning or effect of the European Treaties or Community instruments has to be decided in any proceedings, it is to be treated as a question of law and to be determined in accordance with the principles developed by the European Court. No information is available as to the number of occasions on which courts have had to determine questions of this kind in the course of proceedings.
