Mr. Ron Thomas

asked the Secretary of State for Trade (1) why, when no report was received under the Boiler Explosions Act 1882 in regard to the explosion of a boiler at Flixborough on 1st June 1974, he did not, by notice inserted in the London Gazette in accordance with Section 5(2) of that Act, require that these particulars should be furnished;

(2) why, owing to the default of Nypro (UK) Limited to make a report in accordance with Section 5 of the Boiler Explosives Act 1882 in regard to the explosion at Flixborough on 1st June 1974, no proceedings have as yet been taken under Section 3(3) of this Act.

In the opinion of the Department, the vessel to which the faulty pipe was connected did not constitute part of a boiler within the meaning of Section 3 of the Boiler Explosion Act 1882, and consequently the provisions of Section 5 did not apply.
