asked the Secretary of State for the Environment if he will seek powers to prevent anyone seeking planning consent on any site without both the knowledge and consent of the site owner.

Mr. John Silkin

No. An applicant seeking planning permission for land in respect of which he is not the owner is already required by Section 27 of the Town and Country Planning Act 1971 to take steps to give notice of the application to others having an interest in the land. Since any planning permission granted normally inures for the benefit of the land and not of a particular person, the right to be notified of an application and to make representations to the local planning authority is considered to be sufficient safeguard of the owner's interest.

asked the Secretary of State for the Environment if he will visit Milford-on-Sea in order to see the dilemma in which local authorities can be placed in endeavouring to prevent appeals against planning refusals for blocks of flats based on precedent.
