HC Deb 24 July 1973 vol 860 cc410-1W
Mr. Skeet

asked the Secretary of State for Scotland if he will list the number of times and the statutes in which retrospection has been authorised in Acts originating in his Department which have received the Royal Assent in the past three years.

Mr. Gordon Campbell

Retrospection was authorised in the following Acts:

Redemption of Standard Securities (Scotland) Act 1971 provides that the redemption provisions in a standard security granted before the appointed day may be altered;

Law Reform (Jurisdiction in Delict) (Scotland) Act 1971 extends the jurisdiction of Scottish courts in actions founded on delict to cases where the defender is outwith the court's jurisdiction and covers delicts committed before the Act came into force;

Interest on Damages (Scotland) Act 1971 extends the power of the Scottish courts to award payment of interest on damages and covers actions started before the date on which the Act came into force but in which no trial or proof had been taken or evidence otherwise given by that date.
