§ Mr. Loveridgeasked the Minister of State for Defence what amount of compensation has been paid to the next of kin of the late Malcolm Cousins, who was killed in a motor accident whilst on duty in training with the Cambridge University Officer Training Corps on 1st July, 1971.

Friend will be aware that in this case, as in any other similar case involving the death of a member of the Armed Forces, a common law claim is precluded by virtue of Section 10 of the Crown Proceedings Act, 1947. Whether or not the next of kin have an entitlement to a dependants' award under the scheme administered by the Department of Health and Social Security is a matter for my right hon. Friend the Secretary of State for Social Services.
