Whether they can give an assurance that the provisional antidumping duties on certain nitrogenous fertilisers from Belgium and the Federal Republic of Germany will be payable by the exporter.

NO. These are not duties but provisional charges which normally take the form of cash deposited with H.M. Customs by the importer when the goods are cleared through Customs. The legal liability is on the importer. The deposits are refunded if the provisional charges are not subsequently confirmed by the imposition of antidumping duties before the end of the period for which the provisional charges have been imposed. The normal duration of Orders imposing provisional charges is, as in the present instance, three months.
