HC Deb 06 March 1969 vol 779 cc167-8W
Mr. Horner

asked the Minister of Transport (1) whether he will now require the firm of contractors engaged in building the Midland motorway link in the borough of Warley to provide safe and reasonably clean footways in all the thoroughfares affected by their works and, in particular, in the neighbourhood of Titford Lane, Oldbury;

(2) whether the terms of the contract between his Department and the firm now engaged in constructing the Midland motorway link in the borough of Warley provide for the maintenance of accessibility by the public to their homes, free from danger and encumbrances.

Mr. Bob Brown

As I informed my hon. Friend the Member for Eccles (Mr. Carter-Jones) in reply to his Questions, on 3rd February, any contractor executing roadworks on behalf of the Department is required by the terms of his contract:

  1. (i) to conform with all Acts of Parliament, Regulations and Byelaws of any local or other statutory authority which may be applicable;
  2. (ii) not to interfere unnecessarily or improperly with the public convenience or the access to use and occupation of public or private roads or to or of properties; and
  3. (iii) to keep existing highways, including private roads affected by the works, free from mud and all things deposited thereon by vehicles labour or plant which might either constitute a nuisance or interfere with the public use of such highways or private roads.

I am looking into the matters to which my hon. Friend refers.—[Vol. 777, c. 17.]

Mr. Horner

asked the Minister of Transport what is the estimated cost of the section of the Midland motorway link spanning the borough of Warley.

Mr. Bob Brown

As this section comprises parts of two contracts a precise estimate is not readily available, but the approximate cost is £9½ million.
