Mr. Whitaker

asked the Attorney-General what information he has as to the longest length of time a person has spent in custody awaiting trial during the past year; and what effect the long legal summer recess has on such periods.

The Attorney-General

I regret that this information is not readily available; it is known, however, that there were some exceptional cases in the past twelve months of persons who, following committal spent nearly seven months in custody awaiting trial.

It is not possible to say precisely what effect the summer vacation has on time spent awaiting trial. The only criminal courts directly affected by the vacation are Assizes, which do not normally sit during the vacation. But arrangements are made to ensure that cases of prisoners in custody who intend to plead not guilty
