HC Deb 03 July 1950 vol 477 cc2-3W
Mr. Kaberry

asked the Attorney-General whether he will introduce legislation to revise the proportion of benefits derived on intestacy under the provisions of the Administration of Estates Act, 1925, having regard to the change in values since that date.

The Attorney-General

My noble Friend has decided to set up a committee to examine the matter. The committee will have the following terms of reference:

  1. 1. To consider the rights under Section 46 of the Administration of Estates Act, 1925, of a surviving spouse in the residuary estate of an intestate.
  2. 3
  3. 2. To consider whether, and if so to what extent and in what manner, the provisions of the Inheritance (Family Provision) Act, 1938, ought to be made applicable to intestacies.
  4. 3. To report whether any, and if so what, alteration in the law is desirable.

I am not yet in a position to announce the composition of the committee.
