§ Sir A. Southbyasked the Secretary of State for the Home Department why the word "Directions" was included in Defence Regulation 16A, having regard to the fact that the Emergency Powers Act authorises subordinate authorities to make only regulations, orders and bylaws.
§ Miss WilkinsonDefence Regulations provide in some cases for legislative functions being exercised by subordinate authorities and they do so in pursuance of Sub-section (3) of Section i of the Emergency Powers (Defence) Act, 1939, to which the Question refers. In other cases the Regulations themselves require compliance with executive directions given by those authorised to give them. Regulation 16A is an instance in which both these methods are employed. It may be that the line between the two powers is not always easy to draw, but I do not think any question of substance is involved.
