asked the Parliamentary Secretary to the Ministry of Food whether, in the case of a small poultry-keeper selling only a few birds occasionally to clear off stock he cannot feed, a wholesaler's or retailer's licence is required?

A wholesale licence is not required if the poultry-keeper has himself reared the poultry which he wishes to sell or had the poultry in his possession for the purpose of rearing or is selling the poultry for the purpose of breeding, laying or rearing, or of re-sale for any such purpose. A retail licence is not required if the poultry-keeper has produced or reared the poultry on a garden or allotment which is not occupied solely for the purpose of a trade or business. In all other cases either a wholesale or a retail licence is required according to whether the sale is by wholesale or retail.
