Mr. Logan

asked the Home Secretary whether he is aware that some National Health Insurance members, medically certified as totally incapacitated, and thereby entitled to draw sickness benefit, are being declared by the Appeals Tribunal, under the Fire Watching Order, as liable to undertake fire-watching duties; and will he take action and declare that such decisions, as applied to medically certified totally incapacitated cases, are ultra vires?

This kind of case will no longer be able to occur under our new arrangements for dealing with applications for exemption from fire prevention duties on medical grounds. The only case that has been brought to our notice was at Rhondda and there the local authority did not enrol the persons in question.
