§ Sir J. D. REES
asked the Under-Secretary of State for India whether the Secretary of State is competent to remove a judge of a High Court in India on the ground of incompetency and misconduct, or whether the procedure of an Address to the Crown from both Houses of Parliament obtains in respect of such a judge, as it does in regard to a judge of the High Court of Judicature in the United Kingdom?
§ Mr. HAROLD BAKER
Judges of the Indian High Courts, by statutory provision, hold office during His Majesty's pleasure. It would therefore be within the competence of the Secretary of State to offer advice to His Majesty if there seemed to be good reason. The procedure of an Address from both Houses is not applicable.
