The Earl of Courtown

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 45. This is a technical amendment which removes an unnecessary reference to new Sections 35C to 351 in paragraph 5 of the schedule. These new sections apply only once the community care order has been made. New Sections 35A and 35B allow a community care order to be made in respect of an unrestricted hospital order patient. The reference to Sections 35C to 351 here is therefore not necessary.
