HL Deb 30 June 1994 vol 556 c888

48 Clause 53, page 40, line 21, leave out from 'council' to end of line 22 and insert 'or other public body or to the Residuary Body;'.

Lord Rodger of Earlsferry

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 48. At the same time, I should like to speak also to Amendments Nos. 125 to 131. The amendments concern provisions relating to the residuary body and the, transfer of property to it. Amendment No. 48 clarifies Clause 53(2) (c) so that property transfer orders can be made only to the new principal councils, the residuary body or to other public bodies such as National Parks.

The original drafting included provision for transfers to, such other persons as may be prescribed". I believe that questions were raised on the matter in debates in this House. Accordingly, that provision has now been deleted and made more specific. Amendments Nos. 125 to 131 correct minor technical numbering errors to Schedule 13 which deals with the powers and administrative arrangements of the residuary body.

Moved, that the House do agree with the Commons in their Amendment No. 48.—(Lord Rodger of Earlsferry.)

On Question, Motion agreed to.
