9 Clause 10, page 8, line 3, at end insert: '( ) An order under this section shall make such provision as appears to the council making it to be necessary for the application to the communities included in the group of all or any of the provisions of section 79 of the Charities Act 1993 (parochial charities) and of any of the provisions of this Act with respect to the custody of community documents, so as to preserve the separate rights of each community.'.

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 9. This is a technical amendment to correct an oversight when translating the provisions of the existing Section 29 of the Local Government Act 1972—which deals with the orders for grouping of communities and their dissolution—when that was translated into the new Section 29 to be inserted by Clause 10. The existing Section 29(3) (c) ensures that in making an order grouping communities under a common council, necessary provision is made to preserve the rights of each community to be included in the group with regard to parochial charities or to documents relating to the individual community.

This amendment ensures that future grouping orders under Clause 10 will preserve those separate rights.
