§ Lord StrathclydeMy Lords, I beg to move that the House do agree with the Commons in their Amendment No. 8.I should like to speak also to Amendments Nos.9 to 14. The House will recall that during Third Reading in this House the Government's attention was drawn to a potential gap in the improvements which the Bill makes to protection against trade mark counterfeiting. These amendments enable enforcement authorities to seek the forfeiture of goods seized wherever they can demonstrate to a court chat an offence has been committed under Clause 92; that is, that the goods are counterfeit. This would also apply, once regulations have been made under Clauses 52 and 54, where the offence relates to the use of a Community mark or an international trade mark protected under the Madrid Protocol.
