HL Deb 16 July 1993 vol 548 cc431-2

11.43 a.m.

The Lord Chancellor

My Lords, I beg to move that the House do now resolve itself into Committee (on Re-commitment) on this Bill.

Moved, That the House do now resolve itself into Committee (on Re-commitment).—(The Lord Chancellor.)

On Question, Motion agreed to.

House in Committee (on Re-commitment) accordingly.

[The CHAIRMAN OF COMMITTEES in the Chair.]

Clauses 1 to 56 agreed to.

Clause 57 [Deduction of contributions equivalent premium from refund of scheme contributions]:

The Lord Chancellor moved Amendments Nos. 1 and 2:

Page 41. line 7. leave out ("Subject to the following provisions,").

Page 41, line 15, after ("applies,") insert ("then, subject to the following provisions of this section,").

The noble and learned Lord said: These two amendments address a drafting point which has resulted from the consolidation. It is exactly the same point as I raised in the Chamber a few moments ago in relation to Clause 61 of the Pension Schemes Bill for Great Britain. I beg to move.

On Question, amendments agreed to.

Clause 57, as amended, agreed to.

Remaining clauses agreed to.

Schedules 1 to 3 agreed to.

Schedule 4 [Repeals]:

The Lord Chancellor moved Amendment No. 3:

Page 130, leave out lines 17 to 21.

The noble and learned Lord said: In moving Amendment No. 3 I should like to speak also to Amendment No. 6. The present amendment is consequential upon Amendment No, 6, which replaces paragraph (c) of a definition in Section 170(5) of the Social Security Administration Act 1992. That replacement, which updates the definition to reflect this Bill, makes the repeal of part of that definition unnecessary. Accordingly, the present amendment has the effect of deleting that repeal. I beg to move.

On Question, amendment agreed to.

Schedule 4, as amended, agreed to.

Schedule 5 [Transitional Provisions and Savings]:

The Lord Chancellor moved Amendments Nos. 4 and 5:

Page 134, line 42, after ("has") insert ("or ever had").

Page 134, line 43, leave out from ("words") to end of line 46 and insert (" "paragraph 6 of Schedule 4 to the Social Security (Northern Ireland) Order 1990" of the words "this paragraph".").

The noble and learned Lord said: I beg to move Amendments Nos. 4 and 5 en bloc. The amendments are intended to simplify the rather complex drafting of the paragraph. A few moments ago this Chamber was kind enough to give the benefit of some simplification to the provisions for Great Britain. These amendments do exactly the same for Northern Ireland.

On Question, amendments agreed to.

Schedule 5, as amended, agreed to.

Schedule 6 agreed to.

Schedule 7 [Consequential Amendments]:

The Lord Chancellor moved Amendment No. 6:

Page 143, line 36, at end insert:

("The Social Security Administration Act 1992 (c. 5)

In section 170(5) of the Social Security Administration Act 1992, the following shall be substituted for paragraph (c) of the definition of "the relevant Northern Ireland enactments"—

(c) section 32(6) of the Pension Schemes (Northern Ireland) Act 1993;".").

On Question, amendment agreed to.

Schedule 7, as amended, agreed to.

Schedule 8 [Transitory Modifications]:

The Lord Chancellor moved Amendment No. 7:

Page 149, line 20, leave out ("age") and insert ("and does").

The noble and learned Lord said: The purpose of the amendment is to correct a drafting error. It is the same point as I raised in relation to the Bill for Great Britain. I beg to move.

On Question, amendment agreed to.

Schedule 8, as amended, agreed to.

House resumed: Bill reported with amendments.
