§ Lord Brabazon of TaraMy Lords, I beg to move that the House do agree with the Commons in their Amendments Nos. 38 to 40 en bloc. I shall speak also to Amendments Nos. 94, 96, 97, 103 to 105, and 156 to 158. This is the first group of amendments to the street works provisions of the Bill for the consideration of your Lordships. They are all minor drafting amendments to improve definitions.
Amendments Nos. 38 to 40 improve the definition of "undertaker" in relation to apparatus for the purposes of this Part of the Bill. Amendment No. 94 is an associated change in the definition of the term "statutory right". Amendment No. 96 provides a definition of the circumstances in which apparatus is to be regarded "as affected by works". Amendment No. 97 is a minor consequential amendment. The remaining amendments do the same for Scotland.
