6 Clause 12, page 8, line 9, leave out subsections (3) and (4) and insert: '( ) Any extension toll order must be made so as to come into force not later than—

  1. (a) the end of the toll period under the previous toll order, or
  2. (b) where the concession agreement terminates or is terminated before the end of that period, two years after the termination of the agreement,
whichever is the earlier.'.

7 Page 8 line 20, leave out 'and'.

8 Page 8 line 21, at end insert ', and section (Annual report on concession agreements and toll orders) (annual report by Secretary of State).'.
