HL Deb 18 June 1991 vol 530 c118

163 Clause 161, page 90, line 42, leave out 'this section' and insert 'subsection (4)'.

Lord Brabazon of Tara

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 163. This is a technical correction of the clause concerning application of the Bill to the Crown. The clause is meant to ensure that the street works provisions bind the Crown, but a person acting in the service of the Crown may not be prosecuted. The amendment restricts the immunity to prosecutions under Parts III and IV of the Bill as was originally intended.

Moved, That the House do agree with the Commons in their Amendment No. 163.—(Lord Brabazon of Tara.)

On Question, Motion agreed to.
