HL Deb 18 June 1991 vol 530 c83

56 Clause 57, page 34, line 4, leave out first 'the' and insert 'any'.

Lord Brabazon of Tara

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 56. I shall speak also to Amendments Nos. 169 and 120. These drafting amendments remove some ambiguous wording in two provisions which refer to the right of street authorities, where they own the land on which the street is situated, to charge undertakers for the placing of apparatus in that land. This concern was raised by noble Lords at earlier stages. Amendments Nos. 56 and 169 make clear that no additional rights are conferred on street authorities by the wording adopted in Clause 57 and Schedule 3. Amendment No. 120 does the same for Scotland.

Moved, That the House do agree with the Commons in their Amendment No. 56.—(Lord Brabazon of Tara.)

On Question, Motion agreed to.
