§ 1CB Lord Airedale to move, That this House do not insist on their Amendment No. 1C to which the Commons have disagreed for the reason numbered 1CA, but do propose the following amendment to the words so restored to the Bill—
§ In Commons Amendment No. 1 (new clause (Duty to release discretionary life prisoners) ), in subsection (3), leave out ("subject to subsection (7) below").
§ Lord AiredaleMy Lords, I beg to move Amendment No. 1CB. Having regard to the very encouraging words of the noble Lord the Leader of the House in his opening speech, I believe that I can take this matter very shortly indeed.
If noble Lords look at page 2 of the Marshalled List they will see in line 2 the words proposed to be left out; namely, the words,
subject to subsection (7) below".If noble Lords cast their eyes to the end of the new clause they will come upon the words in brackets and in italics:[A Lords amendment to leave out subsection (7) has been agreed to by the Commons.]That means that the words to be left out,subject to subsection (7) below",no longer have any function. They are left high and dry. They need to be floated off on the next high tide, towed away and sunk.
