§ Lord StrathclydeMy Lords, I beg to move that the House do agree with the Commons in their Amendments Nos. 162 and 163. Clause 44 provides for the chief constable to be able to submit observations to the licensing board on applications for 1625 the grant, renewal or permanent transfer of a licence. These amendments provide that the chief constable may also submit observations on applications for regular extensions of permitted hours and children's certificates where the police view may also be of particular significance in consideration of the application.

§ Lord McCluskeyMy Lords, I should know the answer to this question. As regards Amendment No. 163, paragraph (c) refers to Section 41 of the Law Reform (Miscellaneous Provisions) (Scotland) Act 1990. Has that been properly counted? If it should turn out to be Section 42 or Section 43, is that automatically altered? There has been so much shuffling about that I am not quite sure what is Section 41 of the Law Reform (Miscellaneous Provisions) (Scotland) Act 1990. I do not know whether the noble Lord, Lord Strathclyde, can tell me the answer to that.
§ Lord StrathclydeMy Lords, it has been counted and we believe that Section 41 is right. However, that will be sorted out when the Bill is printed.
§ Lord McCluskeyMy Lords, does that mean that the Government have counted the number of sections in advance of this House taking decisions to allow sections to be amended?
§ Lord StrathclydeMy Lords, that is a good point to make. The Government do not pre-empt the decisions of Parliament. Therefore, at this stage Section 41 is a provisional figure. However, that can be sorted out later.
