5 Clause 2, page 3, line 14, leave out subsection (2) and insert: `(2) For the purposes of this Part of this Act, any body which is not—

  1. (a) a recognised body; or
  2. (b) a body which is—
  1. (i) registered as a charity in England and Wales under section 4 of the Charities Act 1960; or
  2. (ii) a charity which is not required to register by virtue of subsection (4) of that section,
is a non-recognised body.'.

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 5. Clause 2(2) defines the expression "non-recognised body". The subsection was criticised in another place on the grounds that the number of negatives in the clause was confusing. The amendment is a drafting amendment which avoids the use of multiple negatives. The amendment at Clause 13 is consequential.
