HL Deb 24 October 1990 vol 522 cc1414-5

91 Clause 37, page 31, line 46, at end insert:

it may disregard subsections (5) to (8) when imposing the condition.'.

The Lord Chancellor

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 91. I shall speak also to Amendment No. 93. These amendments allow the board to impose a condition on an authorised practitioner immediately, without having to give the practitioner 28 days' notice as required by subsections (5) to (8) of this clause They make it clear that a breach of a condition does not of itself result in loss of authorised status. The purpose is to protect transactions in the pipeline because the board's power to make transitional arrangements is available only if authorisation is revoked or suspended. These amendments protect the interests of clients.

Moved, That the House do agree with the Commons in their Amendment No. 91.—(The Lord Chancellor.)

On Question, Motion agreed to.
