HL Deb 08 November 1989 vol 512 cc827-8

228 Clause 63, page 58, line 37, after 'each', insert 'magistrates'.'

229 Page 58, line 38, leave out 'transmit to him' and insert 'transmit—

  1. (a) to such person as may be specified in the direction; and
  2. (b)'.

The Lord Chancellor

My Lords, I beg to move that the House do agree with the Commons in their Amendments Nos. 228 and 229. These amendments will enable the Secretary of State to require clerks to magistrates' courts to provide management information necessary for operating the concurrent jurisdiction in local authority care and supervision proceedings, by giving the clerk power to direct them to transmit such information as he requires to him or to whomever he may specify. That is the management information collection arrangement that I mentioned earlier in answer to the question from the noble Lord, Lord Prys-Davies, about guardians ad litem. In the higher courts the Lord Chancellor has power to obtain such information because the officials in the courts are officials whom he provides to the courts.

Moved, That the House do agree with the Commons in the said amendments. —( The Lord Chancellor.)

On Question, Motion agreed to.
