193 Page 48, leave out from beginning of line 39 to end of line 15 on page 49 and insert— '(7A) A child shall not be treated as cared for and accommodated in a children's home when—

  1. (a) any person mentioned in subsection (4A)(a) or (b) is living at the home; or
  2. (b) the person caring for him is doing so in his personal capacity and not in the course of carrying out his duties in relation to the home.'
