37 Clause 13, page 10, line 22, at end insert— '(2) The powers of a magistrates' court under section 60 of the Magistrates' Courts Act 1980 to revoke, revive or vary an order for the periodical payment of money shall not apply in relation to an order made under Schedule 1.'

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 37.

The amendment disapplies Section 60 of the Magistrates' Courts Act 1980 in so far as that section would give magistrates power to revoke, revive or vary a periodical payments order made under Schedule 1 to the Bill. Schedule 1 contains its own provisions for that, and therefore that section should be disapplied.
