9 Schedule 18, page 267, line 20, at end insert— (5) The circumstances in which powers shall be exercised only after reasonable notice as provided in sub-paragraph (4)(a) above are—

  1. (a) in an emergency; or
  2. (b) when a pipe is laid in order to comply with a requisition under this Act; or
  3. (c) where the Secretary of State determines it would be exceptionally difficult to obtain within a reasonable time the consent of every owner and occupier of the land where the power is to be exercised and so certifies.".

10 The Commons disagree to this amendment for the following reason: Because it is consequential on Lords Amendment 239 in respect of which the Commons have proposed amendments in lieu.
