138 After Clause 90, insert the following new clause:

'(1) Her Majesty may by Order in Council provide that for the purposes of any part of the law of Northern Ireland which appears to Her Majesty to correspond to this Part of this Act sections 86 to 89 above shall have effect as they have effect for the purposes of this Part subject to such modifications as may be specified in the Order.

(2) An Order in Council under this section may contain such incidental, consequential and transitional provisions as Her Majesty considers expedient.

(3) An Order in Council under this section shall not be made unless a draft of the Order has been laid before Parliament and approved by resolution of each House of Parliament.'.

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 138. We wish to ensure that confiscation orders are enforceable throughout the United Kingdom, regardless of the jurisdiction in which they were made. We propose to bring forward legislation in due course to enable confiscation orders to be made and enforced in Northern Ireland. Clause 93 already contains a power to enable Northern Ireland orders to be enforced in England and Wales. We shall need an equivalent power to enable them to be enforced also in Scotland. That is the purpose of this amendment.

My Lords, surely we should agree with this new clause. However, in the last line of subsection (1), as printed in the Marshalled List, we find the unusual word "midifications". I do not know whether that is an instruction to those concerned to pursue a middle way or whether it has something to do with followng the advice of the Alliance, but I think that it is necessary to have the word corrected to "modifications".

My Lords, my noble friend is unduly perceptive this morning, if I may say so. Of course, he is quite correct, it is a typographical error.
