HL Deb 22 July 1988 vol 499 cc1614-5

119 Clause 64, page 41, line 17, leave out from 'subsection' to end of line 22 and insert

'(3)— (3A) Where a person is convicted of an offence under section I, subsection (1) above shall apply in relation to him with the substitution of two years for twelve months.".'

Page 41, line 22, at end insert—

'(2) Nothing in this section shall have effect in relation to an offence committed before this section comes into force.'.

Earl Ferrers

My Lords, I beg to move that the House do agree with the Commons in their Amendments Nos. 119 and 120 en bloc.

Clause 64 was inserted in the Bill during earlier proceedings in your Lordships' House at the suggestion of the noble Lord, Lord Monson. It increases from one year to two years the minimum period of disqualification for the offence of causing death by reckless driving. However, the drafting of the clause was not quite right and the present amendments correct it.

Moved, That the House do agree with the Commons in their Amendments Nos. 119 and 120.—(Earl Ferrers.)

Lord Monson

My Lords, I should like to take the opportunity to express my appreciation to the other place for tidying up my drafting, while strongly endorsing the principle of the amendment.

On Question, Motion agreed to.
