37 Schedule 3, page 39, line 12, leave out from 'paid' to 'shall' in line 13 and insert 'to a clerk of a magistrates' court in or towards satisfaction of a liability imposed by a contribution order'.

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 37. Schedule 3 to the Bill repeats the provisions of the Legal Aid Act 1974 in respect of the enforcement of contribution orders for criminal legal aid. Paragraph 4(2) of the schedule to which this is an amendment repeats Section 35(7) of the 1974 Act. I am advised that the wording of the 1974 Act is ambiguous and that it is not clear whether it is the contributions themselves that are referred to or the cost of collecting them. This amendment makes it plain that it is the contributions themselves that are intended to be referred to. I commend Amendment No. 37 to your Lordships.
