§ Lord Lucas of ChilworthMy Lords, I beg to move that this House do agree with the Commons in their Amendment No. 121. In speaking to that amendment, I should like to speak also to Amendment No. 142:

142 Clause 48, page 35, line 4, at end insert—
'(5 A) Nothing in this section shall be taken as requiring any such report to include any information the disclosure of which would seriously prejudice the carrying out by the receiver of his functions'.
§ Both amendments deal with the information which the administrative receiver in England and Wales and the receiver in Scotland provides to creditors in his report. These amendments will enable the administrative receiver to exclude information which might be commercially sensitive and likely to prejudice amounts realised on the sale of assets to the detriment of the company's creditors as a whole. I beg to move.
