407 A Line 4, leave out ("(2) to (5)") and insert ("(1)")

The new clause effectively replaces Section 11 of the Insolvency Act 1976, which is repealed in Schedule 9 to the Bill. It provides a remedy for the court against those who deliberately abuse one administration order procedure simply to use it as a delaying technique to their creditors. Amendment No. 395A inserts a repeal consequentially required as a result of the repeal of Section 11 of the Insolvency Act 1976 and its replacement by the new clause introduced by Amendment No. 395. Amendment No. 407 seeks to disapply parts of the new clause in relation to Scotland. It is, unfortunately, incorrect, and Amendment No. 407A corrects that amendment.
