My Lords, I beg to move that this House do agree with the Commons in their Amendment No. 41. This small amendment seeks to remove an uncertainty as to whether the term "marine structure" includes a pipe-line. The question has arisen in the context of Part II of this Bill, where much of the terminology has been taken over from the Dumping at Sea Act 1974. It has always been understood that that Act was intended to deal with dumping from ships, and pipe-line discharges were never licensed under it. The reason is that pipe-line discharges are fully controlled under other legislation; the Control of Pollution Act 1974 and the Radioactive Substances Act 1960.

My Lords, I should like to thank the Minister, or whoever was responsible, for this amendment. This was a matter of concern which we discussed at the very beginning of the Bill and it is very helpful to have it cleared up.
