177 Schedule 10, page 70, line 4 after 'Where', insert 'in the case of a live animal or plant of any kind which is condemned or deemed to be condemned as forfeited'.

178 Schedule 10, page 70, line 5. leave out from 'to' to 'those' in line 7 and insert—

  1. '(a) its return to the wild; or
  2. (b) its being kept at premises (whether within or outside the United Kingdom) which are suitable for the keeping of animals or plants of that kind,'.

My Lords, I beg to move that this House doth agree with the Commons in their Amendment No. 177, which is linked with their Amendment No. 178. With permission, I shall move both of them together. These amendments seek to extend a provision added to Schedule 10 by your Lordships on Report. Under this provision, when a specimen has been condemned or deemed to have been condemned as a consequence of attempted illegal importation, Her Majesty's Customs and Excise may reclaim their expenses in returning it to the country of export—in other words, returning it to the wild. This is in accord with Article VIII of the Washington Convention on International Trade in Endangered Species of Wild Fauna and Flora. I beg to move.
