My Lords, I beg to move that the House doth agree with the Commons in their Amendments Nos. 39 and 40. As drafted, Clause 16(9)(a) does not make it entirely clear that a licence may be issued either by the Secretary of State, after consultation with an advisory body, or by the Nature Conservancy Council. These amendments are designed to make it clear that in Clause 16(9)(a) the NCC is a licence issuing authority in its own right for certain purposes, as well as a body with whom the Secretary of State may consult.
