"Money recoverable by statute

2A. For section 40 (money recoverable by statute) substitute—

40. A county court shall have jurisdiction to hear and determine an action for the recovery of a sum recoverable by virtue of any enactment for the time being in force, if—

  1. (a) it is not provided by that or any other enactment that such sums shall only be recoverable in the High Court or shall only be recoverable summarily; and
  2. (b) the amount claimed in the action does not exceed the amount specified in section 39(2) of this Act."

19 line 42, after "jurisdiction)"insert— (a) in subsection (1)((l), for the words "and any" onwards substitute "(including any sum allotted out of wages or adjudged by a superintendent to be due by way of wages); "; and (b)".
