165 Schedule 7, page 89, line 39, leave out from '409' to 'Provided' in line 41 and insert—
'(1) (payment of fine in part by prisoner), for the words from "by a number" to the end there shall be substituted the words "(or as the case may be further reduced) by a number of days bearing as nearly as possible the same proportion to such term as the sum so paid bears to the amount of the fine outstanding at the commencement of the imprisonment:'.
§ The Earl of MANSFIELDMy Lords, the words inserted by this amendment amend Section 409 of the 1975 Act in order to take account of the difference in approach to part-payment of fines introduced by Clause 49(1D) of the Bill. The inconsistency of approach which necessitated this amendment was pointed out by Sheriff Nicholson, to whom I am obliged. I beg to move.
