My Lords, I beg leave to ask the Question which stands in my name on the Order Paper.

The Question was as follows:

To ask Her Majesty's Government whether they intend to issue to the Civil Aviation Authority a new and revised guidance under the Civil Aviation Act 1971.

Lord TREFGARNE

My Lords, it is the Government's intention to introduce new legislation before any change is made in the existing policy guidance under the Civil Aviation Act 1971.

Lord BOYD-CARPENTER

My Lords, can my noble friend tell me whether that legislation will deal with the current guidance issued by the previous Government which, as my noble friend knows, had a large hole torn in it by the admirable decision of the Court of Appeal?

My Lords, I am afraid I cannot forecast the content of the legislation. I am afraid I must ask my noble friend to await its publication, but I can say that the publication will be very soon.
