HL Deb 19 July 1979 vol 401 cc1507-8

3.38 p.m.

The LORD CHANCELLOR (Lord Hailsham of Saint Marylebone)

My Lords, I beg to move that the House do now resolve itself into Committee on this Bill.

Moved, that the House do now resolve itself into Committee.—(The Lord Chancellor.)

On Question, Motion agreed to.

House in Committee accordingly.

[The EARL OF LISTOWEL in the Chair.]

Clause 1 [Charging Orders]:

The LORD CHANCELLOR moved Amendment No. 1: Page 1, line 16, leave out (" money ") and insert (" a fund ").

The noble and learned Lord said: Perhaps I may deal with all the Amendments at this time. I can really describe them as technical. The purpose of all of them is to substitute for " money " either the words " a fund or " funds ". Some ingenious person has suggested that a clever and ingenious legal mind might confine money to cash when what is intended is funds which may also include investments. I do not think I need go into greater detail unless I am asked; there is greater detail available should the Committee wish it. I beg to move.

Lord MISHCON

On Second Reading my noble and learned friend Lord Elwyn-Jones advocated that the Bill could be readily accepted, and I am quite sure that he would appreciate the delicacy of substituting the word " money " with the word " fund ", and therefore we can find no possible objection to the amendment.

On Question, amendment agreed to.

The LORD CHANCELLOR moved Amendment No. 2: Page 1, line 17, leave out (" by which that money is held ") and insert (" in which that fund is lodged ").

On Question, amendment agreed to.

Clause 1, as amended, agreed to.

Clause 2 [Property which may be charged.]:

The LORD CHANCELLOR moved Amendment No. 3: Page 3, line 13, leave out (" money ") and insert (" funds ").

On Question, amendment agreed to.

Clause 2, as amended, agreed to.

Remaining clauses agreed to.

House resumed: Bill reported with the amendments.
