HL Deb 25 July 1978 vol 395 c804

3 Clause 2, page 3, line 10, at end insert— ("(2A) Upon making a community service order the court shall have regard to the desirability of relating the work to the nature of the offence.")

The Commons disagreed to the above Amendment for the following Reason:

4 Because it is unacceptable in principle, unecessary and drafted in a manner which could lead to confusion.

Lord KIRKHILL

My Lords, I beg to move that this House doth not insist on their Amendment No. 3, to which the Commons have disagreed for the Reason numbered 4. I do not propose to add anything to the debate in your Lordships' House at this stage. The Government's position has been put very clearly before your Lordships' House. So far as this particular Amendment is concerned, the Government consider it to be defective. But the noble Lord, Lord Campbell of Croy, has spoken on both Amendments, and I would not wish to add anything.

Moved, That this House doth not insist on their Amendment No. 3, to which the Commons have disagreed for the Reason numbered 4.—(Lord Kirkhill.)

On Question, Motion agreed to.
