HL Deb 20 July 1978 vol 395 c481

31 Clause 19, page 8, line 33, at end insert ("and if the Judicial Committee decides that a provision is within the legislative competence of the Assembly or is so compatible the decision shall be binding in all legal proceedings.")

The commons agreed to the above Amendment and proposed the following Amendment thereto:

32 Line 3, leave out ("or is so compatible").

Lord McCLUSKEY

My Lords, I beg to move that this House doth agree with the Commons in their Amendment No. 32. This Amendment removes from an otherwise acceptable Amendment on finality of judicial decisions the reference to compatibility with directly applicable Community law. It is consequential on the main Amendments which have just been discussed. There is nothing else to say. I beg to move.

Moved, That this House doth agree with the Commons in their Amendment No. 32 to the Lords Amendment No. 31.—(Lord McCluskey.)

On Question, Motion agreed to.
