Lord ORAMMy Lords, I beg to move that this House doth agree with the 1054 Commons in their Amendment No. 35. Under Clause 16(1), as drafted, the request and fee have to be filed within the prescribed period which will begin on the date of filing. Should the request have been made or the fee paid on the day when application was actually filed but a later date is treated as the date of filing the application under Clause 14, the applicant could not comply with Clause 16(1) unless he filed a second request or fee. The change in wording made by the Amendment prevents this effect, which was never intended.
