36 Clause 15, page 11, line 37, leave out "(4) Subsection (1) above is" and insert— (3A) The following offences under the Night Poaching Act 1828 shall be triable only summarily (instead of only on indictment), namely—

  1. (a) offences under section 2 of that Act (assaults by persons committing offences under the Act);
  2. (b) offences under section 9 of that Act (entering land, with others, armed and for the purpose of taking or destroying game or rabbits).

My Lords, I beg to move that this House doth agree with the Commons in their Amendment No. 36. With the leave of the House, I should also like to speak now to Amendments Nos. 41, 73, 79, 85, 86, 101, 104, 105, 135,160, 161,180 and 195. The objects of this fairly formidable number of Amendments are, first, to deal with an oddity known as the conditionally indictable offence and, secondly, to update and rationalise penalties for offences under the Night Poaching Act.
