§ Baroness STEDMANMy Lords, I beg to move that this House doth agree with the Commons in their Amendment No. 21. Clause 9(2) lists those references to the Secretary of State which in Northern Ireland are to be read as references to the Department of Agriculture. This Amendment makes two changes of substance. It removes the power for Northern Ireland to make separate orders restricting ports 1265 of entry under Clause 4(1), while leaving them with the power under Clause 4(1)(b) to authorise other ports in exceptional cases.
The other significant change is consequent upon Amendment No. 2. In Northern Ireland the Department of Agriculture will have the power to collect any charges made for licences, although the power to make orders enabling such charges to be made will be confined to the Secretary of State.
There are also minor drafting changes to bring the subsection into line with the redrafted and divided Clause 5.
