My Lords, with the leave of the House, I beg to move that this House doth agree with the Commons in their Amendments Nos. 25 and 26. These Amendments allow conditions to be attached to the consents for the flaring of natural gas to maintain consistency with the corresponding provision in subsection (5) of the new clause in Amendment 18. Amendment No. 26 removes the words "or otherwise howsoever" so much criticised both by noble Lords opposite and some honourable Members in another place. Amendment No. 25 alters the subsection to allow the Secretary of State to attach conditions which may, in particular, be framed by reference to the description or origin of the gas, or the quantities to be disposed of. This means that other conditions, apart from those specified, may still be attached to consents for flaring or releasing unignited gas. There are inherent limitations to conditions which may be attached to statutory consents: they must be consistent with the objects of the statutory provisions permitting their imposition".
