At end insert (A) A charter agreed as mentioned in subsection (1) above, or prepared by the Secretary of State in accordance with subsection (3)above, shall provide for the constitution of a body which shall have the functions of—

  1. (a) hearing any complaint by a person aggrieved by a failure on the part of any other person to observe any provision of the charter;
  2. (b) issuing to the parties a declaration as to whether such a complaint is well-founded and if so whether the party aggrieved has suffered material or pecuniary loss by reason of such failure and in what amount, and in such case directing the party in breach to pay that amount; and
  3. (c) securing the publication of its decision.
(B) Any decision by the said body shall be final and conclusive between the parties and any decision of the said body made under paragraph (b) of the foregoing subsection shall be enforceable in like manner as an award made in pursuance of an arbitration agreement by an arbitrator in accordance with the provisions of the Arbitration Act 1950."

The Commons agreed_ to the Lords Amendment numbered 9 with the following amendments:

In subsection (A), paragraph(b), line 2. leave out from("well-founded") to end of the paragraph.

Leave out subsection (B).

My Lords, I beg to move that the House doth agree with the Commons in their Amendments Nos. 10 and 11 to the Lords Amendment No. 9 to the Commons Amendment No. 8. This is one of the Amendments in the name of the noble and learned Lord, Lord Hailsham, which we discussed in a previous debate.

My Lords, I simply confirm what the noble Lord has said. This is my Amendment which, on the advice of my noble friend Lord Carrington, we are not pushing. Therefore, I would advise the House to accept what the noble Lord says.
